Park City Mountain Resort is selling season passes for the 2014-2015 ski season with a caveat related to the lawsuit against its landlord, Talisker Land Holdings, LLC, the third consecutive year PCMR's promotional material has carried a statement about the case.

The caveat says PCMR "plans to operate business as usual" during the next ski season. If that is not the case and the resort is shut down for all or part of the season, the caveat says, season passes will be refunded on a prorated basis. If PCMR is closed for the season, the entire price of a season pass will be refunded, it says.

The caveat's wording is slightly different than the one attached to the material last year. The marketing materials released as PCMR was selling season passes for the 2013-2014 season included a sentence that Talisker Land Holdings, LLC "has stated publicly numerous times that it will not interfere with Park City Mountain Resort's ability to operate."

This year's caveat does not have a similar sentence, likely a result of the de facto eviction notice Talisker Land Holdings LLC served on PCMR in August. The landlord in March filed a motion in 3rd District Court in anticipation of eventually acting upon the eviction notice if upcoming rulings are in its favor. PCMR, meanwhile, recently indicated in a court filing it intends to dismantle and remove most of the ski lifts if it is forced off the land. The other side said PCMR does not have the right to remove the ski lifts.

PCMR spokesperson Krista Parry said the resort is confident that nothing that happens in the lawsuit could imperil a PCMR ski season for at least a year based on the amount of time the case will take and the possibility of an appeal.

"It's guaranteed protection. We want people to (feel) confident about the money they're spending," Parry said.

She said season-pass sales for the ski season that ends shortly were "very strong."

"And we expect the same for next season," Parry said, predicting "business as usual" for the 2014-2015 season.

The caveat attached to the season-pass materials for the next ski season follows:

"Park City Mountain Resort plans to operate business as usual for the 2014-15 season. In the unlikely event the Resort is forced to close for the 2014-15 season, the Resort will refund the full season pass price paid by holders of 2014-2015 season passes. If the Resort is forced to close for a portion of the 2014-2015 season, the Resort will prorate the refund based on the period the Resort is closed."
