The Summit County Council denied an appeal on the Rockport Rocks quarry approval on Wednesday, May 1, assuming the rock quarry meets conditional uses imposed by the county.

"We tried to take into consideration the concerns of the intended use on the property," Councilmember Roger Armstrong said. "I think at the end of the day, we determined, based on the noise studies and a variety of other factors, that it could probably be operated as a good neighbor."

Summit County Councilmember Claudia McMullin said she voted to deny the appeal because the rock quarry is a use that is allowed on the property.

"We felt all the impacts that were brought up by residents were reasonably mitigatable, so we issued conditions that did so," she added.

Residents brought up a number of concerns about the rock quarry, including noise, traffic and dust.

Many of the conditions imposed on the rock quarry were in the original decision by the Eastern Summit Planning Commission.

"We put some additional time restrictions on the rock quarry and modified the number of trucks," Armstrong said. "And they still have to comply with the county's code in terms of noise. And if it has an adverse impact, the county has a right to go in and reevaluate the noise and examine the kinds of impacts it's having," he said.

The rock quarry, located at 7120 North S.R. Peoa, was approved by the Eastern Summit Planning Commission on Nov. 7.

A week later, on Nov. 15, a group of the rock quarry's neighbors filed an appeal of the decision.

The County Council met on March 20, April 17 and May 1 to discuss the issue and acquire more information.

The rock quarry will be built on a two-acre property a half-mile south of the entrance to Rockport State Park at the southern end of the reservoir.

The rock quarry will extract large boulders for landscaping and stream bed stabilization. Summit County Councilmember Roger Armstrong said.

Rockport Rocks quarry conditional use permit conditions

1. Submission of proof of an operating permit and reclamation bond.

2. Quarry work cannot commence until Rockport Rocks has obtained a CWP3 permit.

3. Blasting operations must be carried out by properly licensed personnel. Blasting is limited to 10 a.m. to 3 p.m. Mondays through Fridays.

4. No temporary uses or accessory uses not expressly included within the quarrying operation description are permitted.

5. Operation hours is limited to 8 a.m. to 5 p.m. Mondays through Fridays and 9 a.m. to 5 p.m. on Saturdays.

6. The company shall control mud, rock and dust track-out from the quarrying operation.

7. A ten-foot berm must be constructed along the driveway.

8. Dust must be controlled.

9. The quarrying operation is limited to two acres.

10. Trucks cannot use engine compression brakes.

11. Truck traffic is limited to 140 roundtrip truckloads a month, and 10 roundtrip loads a day.

12. No on-site fuel storage.

13. The company must obtain adequate water from the Mountain Regional Water system for dust control.

14. Rock crushing operations are limited to 10 a.m. to 3 p.m. Mondays through Fridays.

15. If UDOT requires the installation of an acceleration and/or deceleration lane on S.R. 23 due to increased traffic from quarrying operations, Rockport Rocks is responsible for the expense and installation.

16. Rockport Rocks must keep noise to or below 60 decibels at its property line.
