The Park Record

According to the Summit County Attorney’s Office, the following cases were heard on April 27 in the Third District Court at the Summit County Justice Center:

Justin M. Brinton, 35, entered into a guilty plea to theft, a third-degree felony. The court imposed a term of 180 days in the Summit County Jail, with credit granted for 48 days previously served. Upon completion of the commitment the case will be closed.

Michael Mitchell Green, 34, entered into a guilty plea to possession of use of a controlled substance, a class B misdemeanor. The court imposed a term of 180 days in the Summit County Jail and a $1,000 fine. The sentence was suspended and the court ordered the defendant to complete 12 months of court probation, pay a fine of $1,900, where the surcharge has been added to the fine, and complete other standard terms and conditions.

Jacinto Cardenas Medrano, 37, entered into a guilty plea to attempted wrongful appropriation, a class A misdemeanor. The court ordered the defendant to serve 180 days in the Summit County Jail and pay a $2,500 fine. The sentence was suspended and the court ordered the defendant to complete nine months of court probation, pay a fine of $500, and complete other standard terms and conditions.

Krista D. Rebello, 42, entered into a plea in abeyance to possession with intent to distribute a controlled substance, a third-degree felony. The court ordered the defendant to serve 47 days in the Summit County Jail, with credit granted for two days previously served, have good behavior and have no violations of the law, and complete other standard terms and conditions.

Jason M. Skaggs, 34, entered into a guilty plea to possession or use of a controlled substance, a third-degree felony. The court imposed an indeterminate term not to exceed five years in the Utah State Prison. The court imposed a fine of $5,000. That sentence was stayed and the court ordered the defendant to complete 24 months of court probation, serve 30 days in the Summit County Jail with credit granted for 14 days previously served, pay restitution, and complete other standard terms and conditions.

Chance Ray Wilson, 22, entered into a guilty plea to possession of a controlled substance within a correctional facility, a third-degree felony, and driving under the influence of alcohol/drugs, a class B misdemeanor. The defendant entered a no-contest plea to failure to stop or respond at command of police, a third-degree felony. Sentencing is scheduled for June 16.

Sean Wiseman, 27, entered into a guilty plea to theft, a third-degree felony. The court imposed a term of 365 days in the Summit County Jail with credit granted for 100 days previously served. The case is to run concurrent with the defendant’s Davis County case. The court imposed a fine of $5,000. The court ordered the defendant to complete 36 months of supervised probation with Adult Probation and Parole; report to Adult Probation and Parole within 48 hours of release from jail; pay all fines, restitution, and/or recoupment fees directly to Adult Probation and Parole; undergo a substance abuse evaluation and successfully complete any recommended treatment and aftercare and provide proof of completion to the court

Oliver P. Cushenberry, 48, was sentenced for the offense of attempted possession with intent to distribute a controlled substance, a third-degree felony. The court imposed an indeterminate term of not to exceed five years in the Utah State Prison and pay a $5,000 fine. The court suspended that sentence. The court ordered the defendant to complete 36 months of supervised probation with Adult Probation and Parole; serve 180 days in the Summit County Jail with credit granted for 59 days previous served; report to Adult Probation and Parole within 48 hours of release from jail; undergo a substance abuse evaluation and successfully complete any recommended treatment and aftercare and provide proof of completion to the Court.

Candace Mitchell, 34, was sentenced for the offenses of two counts of attempted burglary of a dwelling, both third-degree felonies, attempted theft, a third-degree felony, two counts of burglary of a vehicle, both class A misdemeanors, and two counts of theft, both class A misdemeanors. The court imposed the statutory indeterminate terms for each felony offense and the statutory terms of 365 days in the Summit County Jail for each of the misdemeanor offenses. The court suspended all of the sentences and ordered the defendant to complete 36 months of supervised probation with Adult Probation and Parole; pay all fines, supervision fees, restitution, and/or recoupment fees directly to Adult Probation and Parole; undergo a substance abuse evaluation and successfully complete any recommended treatment and aftercare and provide proof of completion to the court; and complete other standard terms and conditions. The court also gave Mitchell credit for eighteen days that she served in the county jail before sentencing.

Anthony A. Montano, 31, sentenced for the offense of assault, a class A misdemeanor. The court imposed a term of 365 days in the Summit County Jail with credit granted for 66 days previously served. Upon completion of the jail sentence, the case will be closed.

Ashley Page, 32, was sentenced for the offense of attempted aggravated assault, a class A misdemeanor. The court imposed a term of 365 days in the Summit County Jail and suspended 355 days of the sentence for attempted aggravated assault. The defendant was sentenced for the offense of driving under the influence of alcohol/Drugs, a class B misdemeanor. The court imposed a term of 180 days in the Summit County Jail and suspended 180 day of the sentence for driving under the influence of alcohol/drugs. The counts are to run concurrent and commitment is to begin immediately. The court imposed a $2,500 fine for the offense of attempted aggravated assault and suspended $2,000 of the fine. The court imposed a $1,000 fine for the offense of driving under the influence of alcohol/drugs. The court ordered the defendant to complete 24 months of supervised probation with Adult Probation and Parole; complete 50 hours of community service; serve ten days in the Summit County Jail; pay a $1,500 fine; pay all fines, supervision fees, restitution, and/or recoupment fees directly to Adult Probation and Parole; submit to breath and/or urine testing for drugs or alcohol upon the request of any law enforcement and/or probation officer, submit to random urine analysis testing; install an ignition interlock system on each motor vehicle owned by defendant; and complete other standard terms and conditions.
