Summit Water Distribution Company officials are blaming Summit County for a cost hike planned for shareholders by the private Snyderville Basin water provider.
But the company, which serves thousands of people in western Summit County, is delinquent on its personal property tax, Summit County Assessor Barbara Kresser said. The county demanded payment by Nov. 30 "under threat of seizure and sale of Summit Water assets," a recent notice mailed to Summit Water’s shareholders by the company states.
A one-time special assessment is planned to cover the costs.
Summit Water officials claim a case is pending in Third District Court that could resolve the tax debt. According to the company’s board members, the county "breached a prior agreement between Summit County and Summit Water forbearing payment of the disputed amounts pending final resolution by the court."
"It appears that Summit County’s breach of the prior agreement is an effort to retaliate against Summit Water and its shareholders for recent rate comparisons and is not unlike the condemnation action filed by Mountain Regional in 2001 seeking to condemn all of the assets of [class B] shareholders," the notice states.
Summit Water and the county’s Mountain Regional Water Special Service District have competed for customers in Snyderville. But to many of its customers the private water company provides service for about a third the cost of the county, Summit Water attorney John Flitton said.
"It’s just the end of the year and we’re closing out our books," Kresser said. "I’m just doing my job."
Kresser intends to meet with the Summit Water board of directors to discuss the levy. The board is scheduled meet with its shareholders Dec. 8 at 5:30 p.m. at 2950 West Rasmussen Road.
"It’s not really a big deal," Kresser said, adding that she needs an updated property inventory from Summit Water. "It’s just part of doing business to pay your personal property."
She wouldn’t comment on the amount the county claims Summit Water owes but said the debt dates back to the mid-1990s. A land developer wants to construct a 275,000 square-foot lodge with around 350 rooms, Summit County planner Don Sargent said.
The plan, however, has residents up in arms. Sun Peak resident Jaylene Chandler says that the stipulation agreement that guides development in Sun Peak had homeowners expecting only a 140,000 square-foot hotel about a mile up Bear Hollow Drive from S.R. 224.

This week, the Snyderville Basin Water Reclamation District expects construction crews to complete work on a new sewer line west of S.R. 224 near White Pine Canyon Road in the Snyderville Basin.
Traffic delays, however, are expected near the intersection as COP Construction Company crews restrict motorists to one lane on S.R. 224, a sewer district press release states.
According to the release, "The safety of all White Pine Canyon Road users and construction personnel is our top concern."
